A and B are punished by a fine of KRW 4 million, by a fine of KRW 5 million, by Defendant C, E, and G, and by a fine of KRW 2 million.

Punishment of the crime

Any person who intends to engage in credit business shall register with the Si/Gun/Gu having jurisdiction over the relevant place of business, and where an unregistered credit service provider lends a loan, he/she shall not receive interest exceeding the interest rate of 30% per annum.

No debt collector shall assault, threaten, etc. any debtor or his/her related person in connection with the collection of claims.

1. Defendant A

A. On March 25, 2013, the Defendant of unregistered credit business lent KRW 10 million to the victim Q Q for six months at “P” clothes located in the Jung-gu Daegu-guO, Daegu-gu, to receive KRW 1.1.5 million each month. Moreover, from around that time to October 2013, the Defendant extended a total of KRW 61 million to the victim Q Q for 11 times, as shown in the annexed crime list, and operated unregistered credit business.

B. On April 22, 2013, the Defendant violated the interest rate limitation: (a) lent KRW 5 million to Q Q Q without due date; and (b) decided to receive interest at a rate of KRW 63.1% per annum exceeding the statutory interest rate by designating KRW 250,000 per month from the “S” clothing store in Daegu-gu, Daegu-gu; and (c) decided to receive interest at a rate of 63.1% per annum from March 25, 2013 to July 29, 2013, as indicated in the separate list of crimes.

C. On November 1, 2013, the Defendant violated the Fair Collection of Claims Act (hereinafter “Fair Collection of Claims”) at the above S clothes store around 18:00, and in the indictment of the Victim Q Q.

Although the victims of paragraph (C) are written as “C,” it is apparent that it is a clerical error in Qua.
