A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in driving a passenger car in the B SP land.

On January 24, 2020, the Defendant driven the said car with a blood alcohol concentration of 0.101% around 04:20, while under the influence of alcohol, and led the said car to drive the said five-lane road in front of Gwangju Seo-gu along three-lanes.

At the time, there are nights, and there is an intersection where signal lights are installed at the front door, so in such a case, there was a duty of care to prevent accidents by driving a person engaged in driving service by seeing the front door and the left door and safely driving.

Nevertheless, under the influence of alcohol, the Defendant neglected to do so and neglected to do so, and neglected to drive the vehicle on the frontline of the Defendant, thereby being driven by the victim E (the age of 56) who was under the influence of the signal stop on the frontline of the Defendant.

2. Around 04:20 on January 24, 2020, the Defendant driven a B Sti-type car from the roads adjacent to the old registry office located in both villages of Gwangju, Seo-gu to the front roads of Gwangju Seo-gu, while under the influence of alcohol by 0.101% of blood alcohol concentration.
