1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

The Plaintiff was appointed as a policeman on June 30, 2008, and was promoted to the Superintendent on July 1, 2013. From July 25, 2016 to May 18, 2018, the Plaintiff is a police officer working at the Busan Staff Police Station B division from July 25, 2016 to May 18, 2018.

D is a female police officer who has passed the examination for appointment of police officers and served for practical training in the Busan District B District District of the Busan District Police Station on June 12, 2017 and worked in the said B District on August 5, 2017 and worked in the said B District, and is currently working in the Busan District Police Agency E.

On March 19, 2018, the Plaintiff was subject to disciplinary action for two months of suspension from office pursuant to Article 78 (1) 1 to 3 of the State Public Officials Act on the grounds that the Commissioner of the Busan Provincial Police Agency violated Article 56 (Duty of Good Faith) and Article 63 (Duty of Confidentiality) of the State Public Officials Act with respect to the following disciplinary action.

On June 30, 2008, the Plaintiff was appointed as a policeman on June 30, 2008, and was promoted to the Superintendent on July 1, 2013, and on July 25, 2016, the Plaintiff was a police officer working in the Busan District B District.

Police officers shall observe all relevant Acts and subordinate statutes and shall faithfully perform their duties, and shall not engage in any conduct that impairs their dignity, regardless of whether they are inside or outside their duties, the Plaintiff shall be at the time of performing 4 teams of the B District patrol (from July 2017 to January 2018);

A. Around July 2017, the team members affiliated with D (years 28, practice patrol officers, and unmarried) called “in the Republic of Korea may see such a horse,” and sexual harassment was committed in a manner that 2 to 3 times the D’s right-hand hand-ons of the Plaintiff’s left hand-ons of the Plaintiff, which were driven within the said D’s car volume.”

B. At around 23:30 on July 9, 2017, when the team meals and returned to the vehicle of D, the head of the said D under the influence of alcohol was forced to the petitioner’s shoulder.

C. At around 08:30 on July 13, 2017, D is the mixed standard.
