A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On June 27, 2006, the Defendant was sentenced to a fine of one million won as a crime of violating the Road Traffic Act (non-licensed driving), a fine of one million won as a crime of violating the Road Traffic Act at the Seoul Eastern District Court on August 4, 2006, a fine of two million won as a crime of violating the Road Traffic Act (non-licensed driving) at the Seoul Western District Court on January 19, 2015, a fine of two million won as a fine at the Seoul Western District Court on January 19, 2015, and 2.5 million won as a fine from the Suwon District Court on April 27, 2016, respectively.

On February 26, 2017, around 18:00, the Defendant driven B Poter Cargo Vehicles within about 10km from the 23rd road to the front road of Seopo High School located at the center of Seopo High School located at the same city from 23rd to 140 km, Seopo High School.

Summary of Evidence

1. Statement by the defendant in court;

1. The criminal place and the ledger of driver's licenses;

1. Previous convictions: Application of Acts and subordinate statutes of a reply to inquiry, such as criminal history, and a summary order attached to investigation reports;

1. Subparagraph 1 of Article 152 of the Road Traffic Act and Article 43 of the same Act concerning facts constituting an offense;

1. The Defendant’s reason for sentencing selecting a sentence of imprisonment with prison labor is not a significant distance from driving without obtaining a license for the instant crime, and the Defendant’s criminal records of multiple kinds of fines are not good.

However, it is reasonable to consider that the defendant seems to reflect on his gender.

In addition to the above points, the sentencing conditions, such as the defendant's age, sex, environment, and circumstances after the crime, shall be considered, and the sentence shall be determined as per the order.
