A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. No person who violates the Creation and Management of Forest Resources Act shall cut standing timber in a forest without obtaining permission from the competent authority;

Nevertheless, on March 2017, the Defendant cut approximately 180 glus of standing timber, which was planted at the same place to store building materials and create a wooden farm site in a forest area equivalent to 3,470 square meters located in Busan-gun, Busan-gun, Busan-gun, without obtaining permission from the competent authority.

Accordingly, the defendant cut standing timber in the forest without permission from the competent authorities.

2. No person who violates the Management of Mountainous Districts Act or the Act on National Land Planning and Utilization shall divert or engage in development activities for mountainous districts without permission from the competent authority;

Nevertheless, the Defendant, without obtaining permission from the competent authority on March 2017, changed the form and quality of the mountainous district by cutting standing timber and raising it at a height of 0.5 to 4 meters, as described in paragraph (1), in order to construct a building site in a forest with a size of 3,470 square meters located in Busan-gun, Busan-gun, or a forest with a size of 122 square meters located in C, or a forest with a size of 395 square meters located in D.

As a result, the Defendant, without permission from the competent authorities, diverted mountainous districts and engaged in development activities simultaneously.
