1. As to the portion of 992/2,719 square meters among the 2,719 square meters in Ansan-si, Ansan-si, the Defendant B, as to the Plaintiff, the Daegu District Court within the jurisdiction of the Daegu District Court.
Reasons
1. The following facts may be acknowledged in full view of the purport of the entire pleadings in each entry in Gap evidence 21-6, 7, 16, 17, 18, and 21, or in full view of each entry in Gap evidence 1 to 5, 7, 10, 12, 14, 15, 20, Eul evidence 1 to 15, 17, and Eul evidence 21-21:
(2) Around November 2013, the Plaintiff received golf lessons from the said Defendant at a screen driving range operated by Defendant C, and he/she he/she he/she he/she stored a pro rata with the said Defendant.
B. The Plaintiff: (a) had found the site for the construction of a golf practice range around December 2013, 2013; (b) the Defendant C, who had discovered the site for the construction of the golf practice range (hereinafter “Defendant C”); and (c) the 2,486§³ in Ansan-si (hereinafter “No. 1”).
However, G already entered into a sales contract with H, the owner of land 1 at that time, with the content of purchasing KRW 300 million. 2) The Plaintiff agreed on January 25, 2014 to sell the land 1 to E by February 15, 2014 after completing the registration of ownership transfer with respect to the land 1 and until February 15, 2014, while selling the land 1 to E by 413.6 million won (=752 square x 5.5 million won per square x 5.5 million) under the sales contract.
3) Accordingly, E remitted the Plaintiff KRW 20 million around January 27, 2014, KRW 10 million around February 4, 2014, KRW 30 million around February 5, 2014, and KRW 13.6 million around February 6, 2014, respectively, to the Plaintiff, and on February 4, 2014 (hereinafter “J clan”).
4) On February 10, 2014, H, the owner of land No. 1, remitted 10 million won to K, the representative of K, the ownership transfer registration for land No. 1 was completed by G on the grounds of sale.
G obtained a loan of KRW 238 million from the Seocho-dong Agricultural Cooperative on the same day (hereinafter referred to as the “Seodong Agricultural Cooperative”), and completed the registration of the establishment of a neighboring establishment with regard to the land of KRW 1,00,000,000,000,000,000,000 in total, as security, to the land of KRW 31,000,000,000 from the
