A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant, in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents, is a person who is engaged in the business of driving B Costa Car.
On December 3, 2017, the Defendant driven the said vehicle while under the influence of alcohol level of 0.171% from the blood alcohol level around 19:06, and continued to drive the said vehicle at a speed of about 40km from the north-gu, Gwangju, at a speed of about 20km from the north-gu, Gwangju, to the north-gu, Seoul.
At the same time, the victim C(69) was in the atmosphere of the signal, so in such a case, there was a duty of care to prevent accidents by accurately manipulating the steering and brakes while maintaining the distance between the vehicle and the front line.
