C On September 9, 2011, the Seoul Central District Court sentenced two years of suspension of the execution of ten months of imprisonment with prison labor for the crime of giving property in breach of trust, which became final and conclusive on September 17, 201.
1. Defendant A served as the representative director of the J Co., Ltd. (hereinafter “J”) from March 4, 2008 to March 9, 2010; Defendant B served as the director of the J Co., Ltd from April 16, 2007 to August 2009; Defendant C served as the representative director of the J Co., Ltd. (hereinafter “K”) from March 9, 2005 to March 4, 2009.
Since December 202, 2002, the Korea National Land Management Agency (hereinafter referred to as the “National Land Management Agency”) had been implementing construction works with national highways as a substitute for the national highways within the jurisdiction of Jeonju-si, the area scheduled to be a road between Yongsan-si, and caused interference with the above construction works as a transmission station (hereinafter referred to as “the transmission station of this case”). On January 2005, the J company transferred the transmission station of this case to the J company, and the J company decided to move the transmission station of this case to the M, and on January 31, 2005, the J company received later settlement of construction costs in advance from the National Land Management Agency for the relocation of the transmission station of this case.
Since then on August 2006, the J company ordered the above construction and decided to select and proceed with the events in the form of a package order for relocation of the transmitting station of this case, and then on March 26, 2007, the K company was designated as the priority negotiation object and the negotiation was conducted.
B. The JJ company’s preparation of the so-called “Revolving Agreement” and the process of the construction is with respect to the relocation cost of the instant transmitting station from the Korea National Land Management Agency around July 2007 while negotiating the executor’s selection and carrying out the projects related to the relocation of the instant transmitting station.
