1. Basic facts

A. On July 29, 2011, Defendant B, a company that carries out a business of constructing commercial facilities on the ground of Eb block 849 square meters (hereinafter “instant land”), entered into a real estate sale management trust agreement with Defendant Korea Asset Trust for the execution of the instant business. On the same day, the Defendants entered into a business agreement and an agency contract (hereinafter “instant agency contract”) with the National Federation of Fisheries Cooperatives, Daean Construction, Daean C&C Co., Ltd. (hereinafter “T&C”), with the following contents as to the instant land:

The National Federation of Fisheries Cooperatives is a borrower who granted a loan to cover expenses incurred in the project of this case, and the large-scale construction and the large-scale L&C is a new commercial facility construction corporation for the project of this case.

[Real Estate Sale Trust Contract] Trusters and beneficiaries: The first beneficiary of the first beneficiary of the defendant Korea Asset Trust: The second beneficiary of the National Federation of National Federation of Fisheries Cooperatives (the amount of profit limit: 3,863,600,000 won): the third beneficiary: F, C, G (the maximum profit limit: 1,400,000 won) under Article 1(a) of the Act on the Sale of Building in accordance with the "Act on the Sale of Building in Lots", the truster has the purpose of preserving and managing the ownership of the trust real estate (including the case of additional trust of the completed building) and protecting the buyer, and realizing and disposing of the trust real estate when the truster fails to perform his/her obligation.
