1. The Defendant’s KRW 1,2950,00 and the Plaintiff’s annual rate of 5% from January 5, 2016 to May 18, 2016.

1. Basic facts

A. On December 8, 2015, the Plaintiff was driving a dump truck B 25.5 tons of B owned by the Plaintiff (hereinafter “instant truck”) and went back to and from the second line, and is managed by the Defendant as a road management authority, the remaining days of the instant two-way line, which the Defendant was the road management authority, was going to the opening of a rice public health clinic room in the area of the gym intersection, and was going to parallel with the e25.5 tons of D driver’s dump truck, which was proceeding on the opposite line at the same time, around the dong-si.

B. At the time of the above traffic, the Plaintiff proceeded with the instant truck in the direction outside the road, and in the process, the ground below the wheels part above the right side between the road and the right side, which led to the instant truck to the right side.

The plaintiff going toward the left side and tried to have the front right side enter the road again, but the steering gear was not properly operated, and the truck of this case eventually was cut to farmland below 1.2m on the right side of the road while wheeling as it is.

The Plaintiff spent 18.5 million won as repair cost of the instant truck due to the instant accident.

At the time of the instant accident, the width of the Plaintiff’s moving-way road (based on the point from the center line of the road to the point from the outermost line of the road; hereinafter the same shall apply) among the road at the location of the accident was approximately 2.91m, and the width of the opposite-way road was approximately 2.72m.

At the time, the front side of the Plaintiff’s moving-way road is a structure that leads to a sudden slope slope length from the top to the point at which the width is about 0.3 to 0.5 meters is lower than the road, and the side side of the opposite-way road was built of a structure that is equal to not less than 2m of the front land (the road was not installed both on both sides of the road) and the outer side of the direction of the Plaintiff’s moving-way road was covered by the outer direction from the center of the outer white real line to the outer direction, or the outer side of the road covering the soil.
