A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons
Punishment of the crime
The defendant 2016 Highest 1396 is the actual manager of C in Gumi-si B, who is a full-time employee of 10 workers.
1. The Defendant violated the Labor Standards Act, at the above workplace from November 6, 2012 to April 30, 2016, did not pay KRW 5,140,000 in total, including KRW 1,00,000 in February 2, 2016, KRW 1,916,670 in March 2016, and KRW 5,140,004 in April 2, 2016, within 14 days from the date of retirement without an agreement between the parties to the extension of the payment date, and did not pay KRW 10,262,656 in total, including KRW 3,00 in March 2, 2016.
2. The Defendant violated the Act on the Guarantee of Retirement Benefits for Workers in the foregoing workplace, without an agreement between the parties to the extension of the payment deadline, did not pay KRW 7,838,901 of the retirement allowances of the retired worker D within 14 days from the date of retirement, when he/she worked as a maintenance engineer of the body from November 6, 2012 to April 30, 2016.
The defendant 1786 of "2016 Highest 1786" is the actual manager of C in the Gu and America, who ordinarily employs 10 full-time workers.
1. The Defendant in violation of the Labor Standards Act did not pay KRW 2,80,000 of the workers E in charge of vehicle maintenance from April 6, 2015 to May 31, 2016 at the above workplace without agreement between the parties to the extension of the payment deadline, within 14 days from the date of retirement, and did not pay KRW 25,428,646, the total amount of wages of 5 workers, as shown in the attached Table 2 No. 1 to 5 of the daily list of crimes committed, within 14 days from the date of retirement, without agreement between the parties to the extension of the payment deadline.
2. The Defendant violated the Workers’ Retirement Benefit Security Act from April 6, 2015 to May 31, 2016 at the above workplace.
