A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 27, 2015, the Defendant violated the Road Traffic Act (unlicensed driving) driving a rocketing car without obtaining a driver’s license from around 11:05 to the front of the 571 CU convenience store in the same Gun as from the two North Myeon-ri, Incheon, Incheon, the Reinforcement-gun to the two North Myeon-ri, North Do-ri, Incheon, and the strengthening Eup of the same Gun.

2. No motor vehicle which is not covered by mandatory insurance in violation of the Guarantee of Automobile Accident Compensation Insurance shall be operated on a road;

Nevertheless, the defendant operated a passenger car described in Paragraph 1 that is not covered by mandatory insurance at the same time and place as the above Paragraph 1.

Summary of Evidence

1. Statement by the defendant in court;

1. Application of the motor vehicle driver's license ledger and mandatory insurance-related Acts and subordinate statutes;

1. Relevant legal provisions concerning facts constituting an offense, Article 152 subparagraph 1 of the Road Traffic Act, Article 43 (Unlicensed Driving), Article 46 (2), the main sentence of Article 8 of the Guarantee of Automobile Compensation Act, and the choice of imprisonment with labor for each type of crime;

2. The former part of Article 37 of the Criminal Act, Articles 38 (1) 2 and 50 of the same Act, which increases concurrent crimes;

3. According to Article 62(1)(the following favorable circumstances) of the Act on the Suspension of Execution, the Defendant may have the same record as the reasons for sentencing. However, considering the fact that the Defendant is able to reflect the error in depth and there are circumstances that may be considered in the circumstances leading to driving, the sentence shall be determined like the order.
