1. The Defendant shall pay to the Plaintiff KRW 17,741,460 and the interest rate of KRW 15% per annum from February 27, 2018 to the day of complete payment.

1. 인정사실 당사자 사이에 일부 다툼이 없거나, 갑 제3, 4, 5, 9, 10 내지 12, 14 내지 19호증(가지번호 있는 경우, 가지번호 포함. 이하 같다)의 각 기재 및 증인 H의 증언에 변론 전체의 취지를 종합하면, ① 원고가 피고로부터 서울시 은평구 I 소재 다가구원룸주택건축공사(이하 위 주택을 ‘이 사건 건물’이라 하고, 위 공사를 ‘이 사건 공사’라 한다)를 도급받아 2017. 9.경부터 2017. 10.경까지 사이에 터파기공사, 철골공사, 목공공사를 진행한 사실, ② 피고가 원고에게, ㉠ 소외 J 주식회사(이하 ‘J’이라고만 한다)로부터 공급받은 철근대금 중 2,107,000원(부가세 포함, 이하 같다), ㉡ 소외 K 운영의 L로부터 공급받은 건축자재 대금 중 994,460원, ㉢ 소외 M 운영의 N로부터 공급받은 레미콘 및 장비대금 중 1,350,000원, ㉣ 소외 G 외 8명의 목수 노임 중 3,150,000원, ㉤ 소외 O 등에 대한 철근 노임 중 4,620,000원, ㉥ 소외 P 등에 대한 목수 노임 5,200,000원, 합계 17,741,460원(이하 ‘이 사건 공사대금’이라 한다)을 지급하지 않은 사실이 인정된다.

2. Determination

A. According to the above facts of recognition as to the cause of the claim, the Defendant is obligated to pay to the Plaintiff the construction cost of KRW 17,741,460 of this case and damages for delay calculated at the rate of 15% per annum from February 27, 2018 to the day following the delivery of the copy of the complaint of this case, as the Plaintiff seeks.

B. As to the Defendant’s assertion, the Defendant agreed with the Plaintiff that construction of the structural frame of the instant construction shall be KRW 1,100,000 per square meter. However, the Plaintiff continued construction on September 28, 2017, and the Plaintiff’s construction was suspended on or around September 28, 2017, and the Plaintiff’s construction cost is KRW 21,148,600 (i.e., construction cost).
