Defendant

A is the representative director in charge of the affairs of Defendant B corporation who operates the Jongno-gu Seoul building and the ship fuel brokerage business in 1126 Dong.

1. Where a resident of a defendant A intends to engage in transactions with a nonresident in a foreign country regarding the accrual, change, or extinction of a claim arising from a deposit contract, he/she shall report to the Minister of Finance and Economy;

Although the Defendant actually engaged in the business of mediating ship fuel oil in Korea, on April 2010, the Defendant lent a deposit account (Account Number G) in the Hong bean SP S SPC bank established in the name of Hong beacom on Red bea, and opened and used a deposit account (Account Number I) in the name of the company at Hong bea on October 201, and around May 201, the Defendant opened and used the deposit account (Account Number BC) in the Hong bean S SP S SP bank in the name of the company.

The Defendant deposited USD 59,800.00 on May 24, 2010, using the above accounts in the name of Puercom, without reporting to the head of the designated foreign exchange bank the sum of USD 146,049,845.87 (the sum of USD 163,220,349,872) from that time until May 2, 2017, as shown in the annexed crime list, at least 1,234 times, from that time to May 2, 2017.

Accordingly, the Defendant did not report to the Minister of Finance and Economy as above and traded capital.

2. Defendant B, a representative director of the Defendant, violated the Foreign Exchange Transaction Act in relation to the Defendant’s business.
