Reasons
Punishment of the crime
The defendant is the representative of Jung-gu Seoul Central Government C 501 (State)D.
1. Around March 2014, the Defendant stated that “The victim E shall work at the base salary of 1.5 million won and the monthly heavy food cost of 1.20,000 won,” and that “The victim E shall be held liable for the mobile phone fee, as the mobile phone needs to be used for the work.”
However, since the defendant did not have any particular property or income, there was no intention or ability to pay the charges even if he used the cellular phone subscribed in the name of the victim.
Nevertheless, on March 10, 2014, the Defendant: (a) by deceiving the victim as above; (b) caused the victim to purchase 5 ophones (F) equivalent to 684,000, and ophones (G) equivalent to 1,067,000, the market price of which is equivalent to 1,000 won; and (c) did not pay 78,490, and 101,020,020, 101,930,510, and did not pay 1,510,000,000,000 won for five months; and (d) thereby, (e) thereby taking economic benefits equivalent to ophones (G).
2. On April 2014, the Defendant told the victim H of the foregoing D office that “The Defendant would be liable for the fee by opening the Internet and mobile phone necessary for the work under the name of the Party to reduce the basic pay of three million won.”
However, since the defendant did not have any particular property or income, there was no intention or ability to pay the fee even if he used the cell phone and the Internet circuit which was subscribed in the name of the victim.
Nevertheless, the Defendant deceiving the victim and let the victim purchase one unit of LG Plus Internet home service terminal which is equivalent to the market price of 360,000,000 won around April 21, 2014 and one unit of LG Plus Internet home service terminal which is equivalent to the market price of 79,700 won, and continued to purchase one unit of gallus 31 (I).
