Reasons
1. Facts of recognition;
A. The plaintiff clan is a majority of the church set up in C, consisting of four clans, D, E, F, and G, and the defendant is a member of the Fmp among the above four clans.
B. In 1827, the Plaintiff clan compiled the New Year’s 1827, and in the New Year’s newsletter all the members of the Em set up as the descendants of “K” and the descendants of the Dm set up by C 2 South H as the descendants of “I”, and the members of the Em set up as the descendants of “K”, both of which are the descendants of the Plaintiff clan 1827.
The members of the FM claimed that the members of the DM should exclude the members of the DM from the Plaintiff clan on the ground that they did not mention the children of the H and J in the C Newcom, which was established in 1498. Accordingly, the dispute between the members of the Plaintiff clan continued, and the members of the FM operated the Plaintiff clan by taking advantage of one of the members of the Plaintiff’s clan in 1999, while excluding DM and EM from the members of the DM.
C. On November 204, 2004 ( October 9, 2004), the members of the clan, including the Franchis of the Plaintiff clan, held a general meeting in a way that the plenary session is held at L through a preliminary meeting at the National Highway restaurant, and appointed M. The Plaintiff clan held a general meeting at L on November 25, 2009 ( October 9, 2009) and appointed N as representative.
Plaintiff
A clan shall complete the registration of ownership transfer on May 17, 1989, the registration of ownership transfer on the real estate stated in the attached list Nos. 1, 3, and 4, and the registration of ownership transfer on August 28, 1992 with respect to the real estate listed in the attached list No. 2, and the real estate listed in the attached list No. 2 (hereinafter referred to as the "real estate of this case"), and the real estate of this case was used as the "L" and used as the plaintiff's office. On May 4, 2006, the defendant filed against the plaintiff on May 4, 2006 a lawsuit against the plaintiff for the registration of ownership transfer on the ground of the cancellation of title trust (hereinafter referred to as the "previous claim of this case"), and the defendant at the time.
