The prosecutor's appeal is dismissed.

1. Summary of grounds for appeal;

A. The lower court found the Defendant not guilty of each of the facts charged in the instant case on the ground that: (a) the Defendant did not recognize the voluntariness of the confession statement on the date of the first trial of the lower court that conforms to each of the facts charged; (b) the credibility of the Defendant’s testimony on January 6, 2012 after the first trial date of the lower court and the witness C’s testimony; and (c) it cannot be acknowledged that the Defendant was guilty of each of the facts charged on November 5, 2011 on the grounds that it was difficult to find that the Defendant did not conduct a drug reaction test against C due to the change taken from C on November 1, 2011; (c) there was no strong pressure or turn over to the Defendant during the investigation and the trial process; and (d) in light of the Defendant’s legal attitude, it is difficult to see that the Defendant did not have any adverse effect on the Defendant’s testimony on the date of the first trial of the lower court; and (d) it was difficult to recognize the Defendant’s credibility of the Defendant’s testimony or testimony after the lapse of evidence.
