The prosecution of this case is dismissed.

1. The summary of the facts charged is that the Defendant is the driver of the BRabian vehicle.

On April 29, 2017, the Defendant driven the said vehicle at approximately 2 km from the front of the construction site of the apartment site of modern members in the Namyang-si, Namyang-si without a vehicle driver's license, to the front of the apartment site of modern members in the same Eup.

2. However, the fact that the Defendant died on May 19, 2017, prior to the institution of public prosecution of this case, is apparent in the record. As such, the procedure for institution of public prosecution of this case constitutes null and void in violation of the provisions of law.

Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 2 of the Criminal Procedure Act. It is so decided as per Disposition.
