Reasons
1. Details of the disposition;
A. On February 27, 2014, the Plaintiff filed an application for refugee status with the Defendant on July 9, 2015, while entering the Republic of Pakistan for a short-term visit (C-3) sojourn status and staying illegally in Korea after the expiration of the period of stay (C-3 March 29, 2014).
B. On May 10, 2016, the Defendant rendered a decision to deny refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would be subject to persecution, which is a requirement for refugee status.
C. The Plaintiff appealed to the Minister of Justice on June 9, 2016, but was dismissed on December 22, 2016.

2. Whether the instant disposition is lawful
A. On February 11, 2014, the Plaintiff asserted that: (a) the Plaintiff was threatened with the demand of four members of the king in the area of Pakistan; and (b) thereafter, the Plaintiff suffered damage, such as the Plaintiff’s failure to respond to the demand of the king, to the Plaintiff’s house, and the Plaintiff’s failure to surrender the Plaintiff’s house.
Therefore, the disposition of this case which rejected the Plaintiff’s application for recognition of refugee status is unlawful, since the Plaintiff’s return to the Republic of Pakistan is likely to be detrimental to gambling.
(b) The terms used in this Act under Article 2 of the Refugee Act shall be defined as follows:
1. The term “refugee” means a foreigner who is unable or does not want to be protected from the country of nationality due to well-founded fear that he/she may be harmed by race, religion, nationality, status as a member of a particular social group, or political opinion, or who is unable or does not want to return to the country in which he/she resided before entering the Republic of Korea due to such fear (hereinafter referred to as “or the country in which he/she resided”).
