1. The Defendant’s disposition of disability rating rendered to the Plaintiff on February 26, 2018 is revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. On January 16, 1970, the Plaintiff entered the Army and participated in the Vietnam War from November 28, 1971 to October 22, 1972, but was discharged from military service on December 14, 1972.
B. The Plaintiff was recognized as defoliants after the Defendant’s physical examination that “hovascular disease and urine disease” had been determined as Grade VII 1117 and Grade VII 5111.
1) Around 2008, “urine disease,” which is an actual aftereffects of defoliants, was determined to be physical grade 7 and registered as a person of distinguished service to the State. 2) On January 17, 2012, it was determined as follows: (a) on the physical examination conducted on March 13, 2014 as a result of the physical examination conducted on the basis of “urine disease, and her he/she was determined as having been suffering from actual aftereffects of defoliants”; and (b) on March 13, 2014, the Plaintiff applied for a re-examination of “urine disease, urine disease,” and (c) on June 8, 2017, the Defendant was determined as having received a physical examination at the Central Veterans Hospital on July 10, 2017 by the Board of Patriots and Veterans Entitlement to be determined as having been determined as having been determined as having been subject to a comprehensive assessment on the Plaintiff’s disease at Grade 7 and Grade 7 1, respectively.
(1) On July 10, 2017, the Plaintiff’s vision was measured as 0.03 as a result of the physical examination at a central veterans hospital. The physical examination at the above hospital showed that the above hospital’s physical examination constitutes class 7 of urology 7 of urology 115 (the urology of one eye 0.06) (the urology of one eye urology 0.06).
2) On February 12, 2018, the Board of Patriots and Veterans Entitlement deliberated and resolved on February 12, 2018 as follows: (a) the Plaintiff’s urine injury rating falls under Class 7, Class 1117 (A person who has a urine urine urology merger). D. An administrative appeal filed by the Plaintiff against the instant disposition against the Central Administrative Appeals Commission was dismissed on October 17, 2018.
