A defendant shall be punished by imprisonment for not less than five months.

The request of the applicant for compensation shall be dismissed.

Punishment of the crime

1. Fraud;

A. The Defendant, together with D and E, posted a false statement on the sales of goods on the bulletin board of the Republic of Korea D and C, and conspired to use them in division by acquiring the prices of goods from many victims.

Accordingly, on February 7, 2017, the Defendant, along with D, posted a letter and photograph to sell string English B&L franchise “string English,” on the B/C bulletin board, and made a false statement as if the victim F, who reported and contacted this article, would normally deliver the relevant goods.

However, as the defendant did not possess the above goods, the defendant did not have the intention or ability to deliver the above goods to the victim normally.

As above, the Defendant: (a) by deceiving the victim; (b) received KRW 150,00 from the Korean bank account (Account Number: G) in the name of the Defendant on the same day from the victim; and (c) received KRW 2,195,000 from the victim 21 by the same method in collusion with the victim 21 times in total in collusion with the aforementioned list of crimes (1) as shown in attached Form D and E from around that time to February 14, 2017.

Accordingly, the defendant, in collusion with D and E, acquired the victims' property.

B. On February 14, 2016, the Defendant’s sole criminal act reported the purchase of the “Sama-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa-Sa

However, as the defendant did not possess the above goods, the defendant did not have the intention or ability to deliver the above goods to the victim normally.

The defendant deceivings the victim as above and receives 20,000 won from the corporate bank account (Account Number: J) under the name of the defendant on the same day from the victim, as well as from around that time to April 16, 2017 the attached list of crimes (2).
