1. The defendant,
A. For the rest of the plaintiffs except the plaintiff H, the "personal amount" column of attached Table 1 attached hereto and 1.
Reasons
1. Basic facts
A. On December 19, 2006, from around December 29, 2006 to December 29, 2006, the Defendant concluded an agreement on acquisition of each of the lands indicated in the “land acquired through consultation” column of the attached Table 1 (hereinafter “each of the instant lands”) under the Act on the Acquisition of Land, etc. for Public Works and the Compensation Therefor (hereinafter “Land Compensation Act”).
B. At the time of the conclusion of each contract of this case, the Defendant conducted an appraisal on the premise that the land category of each of the instant lands is the same as that on the public register, and paid each of the money indicated in the attached Table 1 “forest compensation” column, which is the amount calculated by multiplying the value of each land by the shares of the Plaintiff’s ownership. At that time, the registration of ownership transfer was completed in the name of the Defendant as to each
C. Article 4(3) of each of the instant contracts provides that “When the sale price has been set excessively or insufficiently due to assessment of intention, negligence, error, etc., the buyer and the seller may claim the excess or deficient amount to the other party, and the buyer and the seller shall immediately pay or return the amount requested by the other party.”
The current status of each land of this case around that time, which was read through the aerial photography taken by the National Land Geographic Information Institute in 1966 and 2006, of land category and area on the public register of each land of this case, shall be as listed below:
