Defendant shall be punished by imprisonment for a term of five years and a fine of one hundred and eighty2,030,368,000 won.

The defendant does not pay the above fine.

Punishment of the crime

Any person who intends to import, export or return goods shall file a report thereon with the head of a customs office on the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree.

Nevertheless, the Defendant made a special production of gold bars with a small type of gold bars of 200 g, employed a hand-on transport book, and concealed them in his/her port text, with a view to importing smuggling from China or exporting it to Japan.

1. From May 10, 2014 to Incheon International Airport, the Defendant imported, without reporting, a total sum of 37 gold bars, including five gold bars (200 g), a total of 1kg, and a total of 47,080,000 won in the market price, which were specially produced in the form of other forms of origin, from March 2, 2014 to January 15, 2017, as the same method, from March 2, 2014 to January 15, 2017, the Defendant employed 37 gold carriage books, such as Defendant D, for a total of 2,519 ggg, market price, 117,75,534,600 won.

2. On February 22, 2016, the Defendant: (a) employed the transport volume of E as a transport volume; (b) concealed five small gold bars (200g); (c) a total of 1kg; and (d) an amount equivalent to KRW 52,68,000 in the market price of the above E in the proviso of the above E; and (c) exported to Japan via the Incheon International Airport; and (d) exported to Japan via the Incheon International Airport; and (c) from around that time to August 8, 2016, the Defendant exported, without reporting, the amount of KRW 18 transportation volume, such as a separate crime list 2 (Smuggling - A), 153.6 km; and (d) imported gold bars total of KRW 7,963,912,00,00 in the same method.
