피고인은 B, C, D, E과 함께 2013. 12. 10. 15:50경부터 같은 날 16:10경까지 창원시 마산회원구 석전동에 있는 마산역 광장에서, 화투 20장을 사용하여 화투패를 5장 받은 뒤 3장으로 10을 만들어 털어 낸 다음 나머지 2장으로 끝수가 높은 사람이 승자가 되어 판돈을 가져가는 방법으로 약 20회에 걸쳐 도금 493,700원으로 속칭 ‘도리짓고땡’이라는 도박을 함께 하였다.
