A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. The defendant has the penal power to punish the violation of the Road Traffic Act and the violation of the Road Traffic Act, with a fine of KRW 700,000,000,000,000 at the Jeonju District Court's Gunsan Branch on May 24, 2010, and with a fine of KRW 4 million at the Suwon District Court on November 27, 2012.
On February 1, 2014, at around 03:20, the Defendant driven a BP motor vehicle under the influence of alcohol 0.083% of blood alcohol concentration without obtaining a driver's license from the front line of the mutually influent main points in the Young-si, Yasan-si to the front line in the Do of the Yasan-si, Yasan-si to the front line in the Do of the 2km-si, Yasan-si.
2. No automobile which is not subscribed for a mandatory insurance in violation of the Guarantee of Automobile Accident Compensation Act shall be operated on a road;
Nevertheless, at around 03:30 on February 1, 2014, the Defendant operated the B SP motor vehicle, which was not mandatory insurance, on the Davelin's road located in the New East East-dong in the following city.
3. On February 1, 2014, at around 03:20, the Defendant: (a) stated that he driven a mandatory insurance without obtaining a driver’s license in front of the Dazin’s road located in the Dazin New East-si, Dazin; (b) stated that he/she was driving the said vehicle; and (c) led C to a false confession.
The Defendant stated that C had a police officer dispatched to the site around that time, and had C drive the said vehicle, and had C prepare a statement of these contents.
Accordingly, the defendant instigated the criminal defendant to escape.
