A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 21, 2006, the Defendant, as the director E of the Dong Government-si D Building Management Agency, provided management services by concluding a service contract for the management of the commercial building, respectively, with the Francing Association at the Government-si around June 21, 2006 and the G commercial building management association at the Government-si around 2013.

The Defendant collected management expenses, including electricity and water supply, from the owners of the above shop shop shop stores, including victims H, and received electricity and water supply, from the owners of the above shop shop stores, and was in custody of the said victims for the said victims, and was 41,076,540 won from August 8, 2015 to December 2, 2015, and the water supply tax of KRW 13,572,640 from May 2, 2015 to December 2, 2015, and the water supply tax of KRW 12,224,130 from June 6, 2015 to December 2015 from the G Subdivision, to KRW 28,795,310, total amount of KRW 95,668,620 from September 20, 2015 to December 12, 2015.

Accordingly, the defendant embezzled the property of the victims who had been under custody in the course of business.
