Punishment of the crime
" 2017 Gohap 420"
1. On September 11, 2017, the Defendant was under the influence of alcohol content of 0.183% in blood without a driver’s license on around 13:00 on September 11, 2017, the Defendant driving a clater in the section of approximately 3km to the road near the Daegu Metropolitan City, Dong-gu, Daegu Metropolitan City, Suwon-gu, Daegu-gu, about 400 meters in front of the clateral main road.
2. On September 11, 2017, the Defendant: (a) was under the influence of alcohol while driving a low-income vehicle on the street in front of the Daegu-gu Seoul Metropolitan City, Suwon-gu, Daegu-gu, 400, and was stopped on the road; (b) later, the fire officer D belonging to the fire station of the Daegu-dong fire department called the scene upon receiving a report from 119 and called “a driver was under the influence of liquor while stopping on the road; and (c) was assigned to the fire station of the Daegu-dong fire department called the scene after receiving a report from 119 to the emergency situation; (d) was accompanied by the first lower seat of the vehicle; and (e) the fire officer E enters the back seat and opened the front door, thereby attempting to enter the fire officer D to the front door; and (e) the fire officer F was going into the atmosphere outside the vehicle.
In the written indictment, the fire-fighting officer D enters the front seat, open the front door, and entered the front door by the fire-fighting officer E. However, according to the evidence of this case, it is recognized that the fire-fighting officer D and E acted in the same manner as the above facts constituting the crime.
The defendant recognized all the natural facts that occurred at the time of the instant case, and it does not seem to affect the defendant's exercise of his right to defense even if criminal facts are recognized as above, and thus, it is recognized as above ex officio.
