Reasons
Punishment of the crime
[Criminal Power] On November 4, 201, Defendant A sentenced Defendant A to two years of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at Seoul High Court, and completed the execution of the sentence on March 31, 2013.
【Criminal Facts】
1. Although the Defendants’ co-principals did not constitute a person handling narcotics, Defendant A sought a person to supply psychotropic drugs-related psychotropic drugs-related camphones (hereinafter “camphones”) in China to purchase camphones, and Defendant B was in charge of hiding camphones purchased by Defendant A and transporting camphones into the Republic of Korea and carried them into the Republic of Korea, thereby smuggling with A.
Accordingly, on December 12, 2013, Defendant A left the China’s Cheong-do to purchase a nameless box (E) with which he/she will supply phiphones to the Defendants. Defendant B left the China’s Cheong-do on December 13, 2013 following a day. The Defendants got 39.27g of philopon from the above nameless apartment in the Chinese Cheong-do.
In addition, at around 07:00 on December 14, 2013, Defendant B concealed 39.27 ghon, which was sealed into vinyl and Red Sea, in one’s port, with Defendant A, on board at around 10:00 on the air (U.S. S. S.C4617) starting from the Chinese Cheongdo Port, and arrived at the Incheon National Port on the same day at around 11:20 on the same day, and the Defendants conspired to import phiphones in collusion.
2. Defendant A’s crime;
A. On December 13, 2013, the Defendant violated the Narcotics Control Act, even though he is not a person handling narcotics, at a accommodation facility located in the Chinese Cheongdo around December 22:30, 2013, the Defendant laid down a bitphone at a gambling place, and then removed the bitphones caused by heating on the lower side by passing through the water and then administered the bitphones by spreading it.
