A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Any person who intends to convert a mountainous district of 2016 Highest 882 shall obtain permission to divert a mountainous district from the Minister of the Korea Forest Service, etc.

1. Nevertheless, on April 2014, the Defendant, while carrying out civil engineering works to build a factory in the Ilcheon-si Forest and C Forest House, was using heavy equipment, such as scrails, etc., and cut and filled up the land and diverted the gradient of which is 788 square meters of the D forest in Leecheon-si without obtaining permission for mountainous district conversion.

2. Nevertheless, on March 2015, the Defendant, while carrying out the civil construction works to construct a factory in the Ilcheon-si Forest and C, was converting the use of mountainous districts into mountainous districts without permission, by cutting down trees of 1,766 square meters in E-si, E-si, F forest and forest, 366 square meters in F forest and forest, and 132 square meters in G forest and forest.

Nevertheless, while the Defendant was performing the civil construction work to construct a factory in the Ilcheon-si, Leecheon-si, the Defendant cut and filled up the gradient by using heavy equipment, such as scrain, etc. while lowering the gradient of which is 568 square meters of H forest, 164 square meters of I forest, 164 square meters of J forest, 730 square meters of J forest, 3,635 square meters of K forest and diverting the diversion of mountainous district.

A person who intends to convert a mountainous district of "2016 Highest 1151" shall obtain permission from a competent authority according to the classification of the types, areas, etc. of mountainous districts according to the purpose thereof.

Nevertheless, the Defendant, from around December 18, 2015 to around December 21, 2015, performed civil engineering works to build a new factory in the Dongcheon-si Forest and C, and converted the use of mountainous districts by cutting the total of 306 square meters of forest land, including 248 square meters of KK forest and 58 square meters of forest land, without obtaining permission for conversion of mountainous district.
