A defendant shall be punished by imprisonment for not less than eight months.

"2012 Highest 6258"

1. Around 11:00 on April 23, 2012, the Defendant made a false statement to the victim F “E” office located in Suwon-si, Suwon-si, stating that “E will act on behalf of the victim F to purchase real estate from the preceding auction.”

However, in fact, there was no intention or ability to sell real estate by proxy or by proxy.

As such, the Defendant deceiving the victim and received 2 million won from the victim, namely, a proxy fee, under the pretext of contract deposit.

On August 28, 2012, the Defendant received a telephone from the said victim that “ how it would not bring about the documents for the transfer of real estate even if one month has passed from the remittance of the down payment,” and the Defendant was prohibited from purchasing the victim by raising KRW 10 million by the owner of the building, i.e., lending from the victim. He/she would allow the victim to purchase other lendings of KRW 80,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000 won.”

However, the facts did not have the intention or ability to purchase the lending.

As such, the Defendant, by deceiving the victim, is under the name of the Defendant on August 28, 2012 from the victim.
