피고인은 2013. 4. 26. 00:20경 광주 광산구 G, 6층에 있는 H 주점 입구 엘리베이터 앞에서 피해자 I(여, 31세), 피해자 J(여, 30세)이 귀가하기 위해 엘리베이터를 기다리고 있는 것을 발견하고 강제추행할 마음을 먹고, 피해자 I의 허리를 한손으로 감싸 안고 피해자 I의 얼굴에 자신의 얼굴을 가까이 들이밀며 입맛을 다시듯 혀를 내밀어 자신의 입술을 핥고, 이어 피해자들과 같이 엘리베이터에 탄 다음 오른손으로 피해자 J의 가슴 부위를 만지면서 키스하여 위 피해자들을 강제로 추행하였다.
