Defendant shall be punished by a fine of KRW 700,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Any person who intends to store goods in a green area, control area, or natural environment conservation area in violation of the National Land Planning and Utilization Act for at least one month shall obtain permission from the competent authority;

Nevertheless, from May 2012 to January 4, 2017, the Defendant: (a) performed an act of piling up articles, such as waste household appliances, waste materials, and scrap metal, among the above land, on the part of approximately KRW 67 square meters and approximately KRW 150 square meters among the above land, without obtaining permission from the competent authority; and (b) performed an act of piling up articles, such as waste household appliances, waste waste materials, and scrap metal, among the above land, in order to operate a water tank on each of the above land without obtaining permission from the competent authority.

2. A person who intends to build a building the total floor area of which does not exceed 100 square meters in total shall file a report with the competent authority in advance as prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.

Nevertheless, on October 2014, the Defendant respectively constructed a building with a total floor area of approximately 21 square meters, including one container of approximately 12 square meters in floor area and one container of approximately 9 square meters in floor area, in order to operate a high-water shop without reporting to the competent administrative office.

3. Any person who intends to occupy and use land in a river area that violates the River Act shall obtain permission from the competent river management agency, as prescribed by Presidential Decree.

Nevertheless, from May 2012 to January 3, 2017, the Defendant occupied and used the part equivalent to approximately 150 square meters of waste household appliances, waste materials, scrap metal, etc. on the said land without obtaining permission from the river management authorities in Gyeyang-si (a approximately 28,817 square meters) located in the river area from May 3, 2012 to January 3, 2017.
