1. The plaintiff's appeal is all dismissed.

1. The plaintiff's assertion

A. The Plaintiff, as the party, concluded an automobile insurance contract with A on BSF car owned by A and A (hereinafter “Plaintiff vehicle”).

Defendant Republic of Korea is the implementer of road expansion works as the Olympic Games near Gangseo-gu Seoul Metropolitan Government, and Defendant Seoul Metropolitan Government is the management authority under the Road Act for the above roads.

B. On December 5, 2013, A, while driving the Plaintiff’s vehicle at around 19:30 on December 5, 2013, the occurrence of the instant accident, two lanes out of the three-lanes in the Gangseo-gu Seoul Metropolitan Government Gang Winter Olympic Games (hereinafter “instant road”).

그러던 중 2차로 중앙의 1자형으로 길게 움푹 파인 도로를 밟고 지나가다 원고 차량의 타이어 및 휠이 손상되는 사고(이하 ‘이 사건 사고’라고 한다)가 발생하였다.

The Plaintiff paid KRW 2,712,00 to A with insurance proceeds from the instant accident.

The accident of this case occurred due to the defect of the road of this case, and the defendants failed to fulfill their duty to take protective measures against the road of this case. Thus, the defendants are liable to compensate the damages caused by the accident of this case as the possessor and manager of the road of this case pursuant to Article 758 of the Civil Act and Article 5

2. In full view of the following circumstances, there are defects in the construction and management of the road by the Defendants, taking into account the descriptions and images of the evidence Nos. 1 through 10 and the entire purport of the pleadings:

It is insufficient to recognize that the accident of this case occurred or as a result thereof, and there is no other evidence to acknowledge it.
