1. All claims against the Defendants are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The plaintiff's assertion
A. Defendant B’s embezzlement and breach of trust (i) Defendant C’s father who is the representative of Defendant D, Defendant D’s embezzlement, and Defendant B, who actually operated Defendant D, work as the vice president between January 2, 2012 and March 2013, and worked as the Plaintiff’s vice president from January 2012 to March 2013, the Plaintiff’s polybligate owned by the Plaintiff (hereinafter “pool wall”).
(2) Defendant D, at his own discretion, sold to the customer in the name of Defendant D, and embezzled KRW 488,09,475 in total ( KRW 394,520,00, which was directly brought by Defendant D to the customer through Dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong dong 1,579,475), with Defendant D’s breach of trust related to the excessive payment of the original revenue price, imported the original capital from abroad to August 2012, and supplied the Plaintiff with the tax invoice. Even if Defendant D’s duties were not only to issue the tax invoice, Defendant D had the Plaintiff purchase the original capital from Defendant D at a price with excessive 10% to 199% of the import price of the original capital, and had the Plaintiff gain a total of KRW 146,195,333, as shown in attached Table 1, and made the profit equivalent to Defendant D.
3) From August 2012 to December 2012, 2012, Defendant D supplied the provisional construction to the Plaintiff. Accordingly, the Plaintiff’s price of the goods paid to the Plaintiff is KRW 1,582,609,041. However, Defendant D’s total production cost is KRW 1,101,59,820, including raw material cost, labor cost of KRW 43,000,000, including labor cost, and KRW 34,337,875, adequate 28,053,120 (the volume of the provisional construction 43,83km x 1k x 640 won x 1,206,815 x 1k x 206,2815 - Defendant D’s total production cost is calculated as KRW 261,2665,2756,2865,2756,2756,276,2765, and 296,2666,25.2,25
The Defendants are liable for damages.
