Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for one year, respectively.
, however, for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant
A is a person who is a spouse who has completed a marriage report with E on December 6, 2004.
1. Defendant A
A. At around 14:00 on June 11, 2012, Defendant A provided one-time sexual intercourse with Defendant B at GMoel located in Dobong-gu Seoul Metropolitan Government F.
B. At around 14:00 on September 19, 2012, Defendant A sent her sexual intercourse with Defendant B at GMoel located in Dobong-gu Seoul Metropolitan Government F.
C. At around 15:00 on October 29, 2012, Defendant A and Defendant B provided one-time sexual intercourse with Defendant B at GMoel located in Dobong-gu Seoul Metropolitan Government F.
Defendant
A around 15:00 on December 12, 2012, at Gmotour located in Dobong-gu Seoul Metropolitan Government F, provided that Defendant B and Defendant B met once.
Accordingly, Defendant A was linked to Defendant B through four times respectively.
2. Defendant B
A. While being aware that Defendant A has a spouse, Defendant B had sexual intercourse with Defendant A four times, respectively, at the time and place specified in paragraph (1), as described in paragraph (1).
(b) No person Promotion, etc. of Information and Communications Network Utilization and Information Protection Act shall allow any person to reach other persons repeatedly in the form of code, words, sound, image, or picture creating fear or apprehensions through an information and communications network;
그럼에도 피고인 B는 2013. 1. 9. 20:09 장소를 알 수 없는 곳에서 피해자 E의 휴대전화로 ‘A씨 문제로 찾아뵈려고 합니다. 미리 양해를 구하는 것은 전화를 피하셔서 불가피합니다.’라는 문자메시지를 전송한 것을 비롯하여 그 무렵부터 2013. 1. 30.까지 사이에 별지 범죄일람표 1 기재와 같이 383회에 걸쳐 문자메시지를 전송하고, 2013. 1. 10. 20:02 피해자의 휴대전화로 ‘야 이 미친 인간아 너 죽고 나 죽는거야. 도저히 못 참겠다. 이제 이 미친 영감탱이 두고 봐라. 내가 니네 용서하는가. 내가 두고봐.’라는 음성메시지를 전송한 것을 비롯하여 그 무렵부터 2013. 1. 29.까지 사이에 별지 범죄일람표 2 기재와 같이 21회에 걸쳐 음성메시지를 전송하여...
