1. 피고인은 대출 알선을 목적으로 D의 주민등록증 사본을 받은 것을 기화로 2014. 11. 3. 경 서울 송파구 석촌동 175에서 AJ 네트 웍스 주식회사로부터 TV 렌탈을 신청하는 데 행사할 목적으로 권한 없이 스마트 렌 탈신 청서란의 가입신청고객정보란에 D의 이름과 주민등록번호를 기재하고, 렌 탈이용 자란에 D의 이름을 기재하고 그 옆에 서명함으로써 권리의무에 관한 사문서인 D 명의 스마트 렌 탈신 청서 1 장을 위조하고, 즉석에서 그와 같은 사정을 모르는 AJ 네트 웍스 직원에게 위와 같이 위조한 스마트 렌 탈신 청서를 마치 진정하게 성립한 것처럼 교부함으로써 이를 행사하였다.

2. 피고인은 전항 기재 일시, 장소에서 사실은 피고인이 D 인 것처럼 행세한 것뿐이고 피해자 AJ 네트 웍스 주식회사로부터 TV 1대를 렌탈하더라도 피고인이 매달 렌탈료를 성실히 지급할 의사나 능력이 없음에도, 위와 같이 스마트 렌 탈신 청서를 위조하여 이를 교부하는 방법으로 피해 회사의 담당직원을 기망하여 이에 속은 피해 회사로부터 같은 날 시가 1,652,320원 상당의 삼성 50인치 LED TV 1대를 교부 받아 이를 편취하였다.
