The defendant's appeal is dismissed.
Reasons
1. The decision of the court below on the gist of the reasons for appeal (two years of suspended sentence to six months of imprisonment) is too unreasonable.
2. The judgment of the court below is a favorable circumstance that the defendant led to the confession of the crime of this case, and the crime of this case is concurrent crimes with the crime of violation of the Act on the Control of Narcotics, Etc., which became final and conclusive on April 11, 2015, and the crime of this case after Article 37 of the Criminal Act, and the crime of this case is concurrent crimes after the latter part of Article 39 (1) of the Criminal Act. However, in light of the addiction to narcotics and the harm caused by medication of narcotics, etc., there is a need to strictly punish and eradicate the crimes of this case, and there is no special circumstance or change of circumstances that may be newly considered after the sentence of the court below, and there is no other special circumstance or change of circumstances that may be newly considered after the sentence of the court below, and considering all the records and changes in the sentencing theory of this case such as the defendant's age, sex, environment, motive, means and result of the crime of this case, there is no reason for the court below's assertion that the defendant's punishment is unfair.
3. In conclusion, the Defendant’s appeal is dismissed under Article 364(4) of the Criminal Procedure Act on the grounds that it is without merit, and is so decided as per Disposition (Article 25(1) of the Rules on Criminal Procedure: Provided, That the court below’s ex officio pursuant to Article 60(1)2 and Article 4(1)1 of the Act on the Control of Narcotics, Etc. (Article 60(1)2 and Article 4(1)2 of the Act on the Control of Narcotics, Etc. (Article 60(1)2 and Article 60(1)3(b) of the Act on the Control of Narcotics, Etc.
