1. The defendant shall be the plaintiff.

A. The attached appraisal map No. 4,35 through 35 is marked among B forest land No. 5,501 square meters and C forest land No. 4,860 square meters in Pakistan-si.

1. Determination of removal and delivery claims

A. (1) On April 29, 1997, the Plaintiff acquired ownership of B forest land B 5,501 square meters, C forest land 4,860 square meters (hereinafter “instant forest”).

(2) 원고는 2009. 5. 27. 파주시 D면에 건축신고를 한 뒤 토목공사를 하면서 이 사건 임야에 설치되어 있던 벙커 4동, 개인호 10동, 교통호 250 m를 훼손하였고, 군이 원상복구를 요구하자 2011. 8.경부터 같은 해 10.경까지 사이에 별지 감정도 표시 4, 35 내지 44, 9, 8, 7, 6, 45 내지 58, 5, 4의 각 점을 차례로 연결한 선내 나 부분 교통호 341㎡, 별지 감정도 표시 5, 102 내지 117, 4, 5의 각 점을 차례로 연결한 선내 마 부분 교통호 319㎡, 별지 감정도 표시 8, 9, 88 내지 101, 8의 각 점을 차례로 연결한 선내 바 부분 교통호 126㎡, 별지 감정도 표시 1, 2, 3, 4, 5, 1의 각 점을 차례로 연결한 선내 ㄱ 부분 지하진지 26㎡, 별지 감정도 표시 6, 7, 8, 9, 10, 6의 각 점을 차례로 연결한 선내 ㄴ 부분 지하진지 6㎡, 별지 감정도 표시 ㄷ~ㅋ 부분 1, 2, 3, 4를 차례로 연결한 사각진지 각 5㎡, 별지 감정도 표시 ㅌ~ㅎ. ㄱ1 부분 1 내지 11을 차례로 연결한 원형진지 각 5㎡, 별지 감정도 표시 선내 ㄴ1 부분 1, 2, 3을 차례로 연결한 대전차진지 27㎡(이하 ‘이 사건 군사시설’이라 한다)를 설치하였다.

B. According to the above facts of recognition as to the cause of the claim, the defendant occupied the military installations of this case and assessed not only on the corresponding part of the forest of this case but also on the attached appraisal.
