The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

1. In order to seek work together with C and D that came to know at the church located in Geumcheon-dong, Cheongju-si, the Defendant was in need of living expenses. As such, due to the mental delay, the Defendant had taken a mind to steals another’s property while having weak mental capacity to discern things or make decisions.

The defendant, C, and D are located on October 7, 2015 at the second floor of the F Burial in Dongdaemun-gu Seoul Metropolitan Government around 02:40, in order to keep the victim G in a cresh between toilets, the defendant and D reported the network, and C took one credit card of the victim from the wall located within the victim's bank.

The Defendant, in combination with C and D, who had the ability to discern things or make decisions due to mental delay, stolen property worth KRW 1,050,000, total of the victims, from October 13, 2015 to October 22:20, 2015.

2. On October 7, 2015, at around 03:28, the Defendant violated the Act on Business Specializing in Fraud and Credit Business: (a) on the part of the I Hospital located in Dongdaemun-gu Seoul, the victim J was boarding a taxi and moved to the New Village in Seoul Seo-gu, Seoul; (b) on the part of the passenger hospital located in Dongdaemun-gu, Seoul; (c) on the part of the passenger hospital located in the I Hospital located in Dongdaemun-gu, Seoul, the Defendant suggested that he was the credit card holder of C; and (d) upon paying the taxi fee of KRW 22,920, a stolen credit card was illegally used.

From that time to October 7, 2015, the Defendant, in collusion with C and D, under the state that the mental delay from that time to October 18:05 lacks the ability to discern things or make decisions, presented the credit card which was stolen to the victims over 15 times, as if it were C’s credit card, and paid a sum of KRW 2,186,420, and acquired the same amount of pecuniary benefits and stolen credit card.
