A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2019. 11. 20. 19:35경 B 쏘렌토 승용차를 운전하여 대구 수성구 C에 있는 D 황금동본점 앞 편도 5차로 도로를 황금네거리 쪽에서 들안길네거리 쪽으로 진행하다가 정차한 후 일행을 내려주고 네비게이션을 조작하던 중, 뒤에 있던 ㈜E 소유인 F 시내버스 운전자인 피해자 G(45세)가 경적을 울리고 상향등을 켜고 4차로로 차로를 변경한 후 피고인 승용차의 왼쪽 옆으로 다가와 ‘비상등을 켜고 정차를 해라’는 취지로 항의하자 화가 나, 피해자 G에게 “야이 개새끼야. 눈깔 쳐 뜨고 댕기면 내 차 보일 것이고, 차가 보이면 니가 알아서 피해 가면 되지 왜 시비를 거노. 평생 버스나 운전해라”고 욕설을 하고, 이에 피해자 G가 피고인을 무시하고 그냥 위 버스를 출발시키자 위험한 물건인 위 승용차를 출발시켜 3차로로 진행하다가 4차로에 있는 위 버스를 추월하여 4차로로 급하게 차로를 변경한 후 위 버스 앞에서 급하게 제동하여, 피해자 G로 하여금 충돌을 피하기 위하여 급하게 위 버스를 정지하게 함으로써, 위 버스 뒷문의 뒤쪽 첫 번째 좌석에 앉아 있던 피해자 H(64세)이 앞으로 튕기면서 그곳에 있는 가림막 강화유리에 부딪히게 하고, 그 뒤에 앉아 있던 피해자 I(여, 23세), 피해자 J(여, 22세)이 앞으로 튕기면서 앞 좌석에 부딪히게 하였다.
