A defendant shall be punished by imprisonment for a term of one year and three months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Power of crime] On April 16, 2018, the Defendant was notified of a summary order of KRW 1 million due to larceny, etc. in the Busan District Court’s Dong Branch Branch, and on May 30, 2018, the Defendant was notified of a summary order of KRW 700,000 as a fine for embezzlement, etc. in the same court.

1. Embezzlements of deserted articles in possession;

A. On May 2018, the Defendant, at the street near the Dong-gu, Busan-do, Busan-do-Eup market on the date, embezzled the Defendant, without following necessary procedures, without taking necessary procedures, such as acquiring a flue PC (mar PC) in the market where the victims of non-defluence in name were deprived, and returning it to the above victims.

B. On June 2018, the Defendant: (a) obtained one unit of gallon (S6) at the city in which the victim in the name was deprived of, and returned to, the above victim in, the city in which the victim in the name was deprived of, Busan-do, Busan-do; (b) and (c) embezzled it on his own, without following necessary procedures.

2. Larceny;

A. From June 2018 to August 2018, the Defendant: (a) opened an unreshed door-to-face D News Twit-to-land car located in the Busan-gun, U.S., Busan-gun; and (b) stolen one head of the Tong owned by the said injured party, which was kept in the driver’s seat, and was in custody in the said D News Twit-to-land car owned by the said injured party; (c) and (d) cut off 10 head of the Tong owned by the said nine victim in total nine times in total from Jun. 2018 to Aug. 2018 by the following means: 10 head of the Tong owned by the said victim, one credit card (Korean bank), one smartphone (S2) and one smartphone (S2).

B. On July 21, 2018, the Defendant: (a) entered the cash automatic payment machine installed at the 14th Busan Busan Metropolitan City branch office, 783, the 16:56 Busan Metropolitan City, the Busan Metropolitan City, the 100,000 won in cash after inserting the passbook in the name of the victim C, as described in the above 2-A, into the cash payment machine; and (b) entering the password in the passbook.
