A shall be punished by a fine of KRW 2,500,00, and by a fine of KRW 1,500,000, respectively.

Reasons
Punishment of the crime
1. Any person who intends to operate a common-use passenger transport business by the Defendants shall obtain a license or obtain registration from the competent authority, and no person who rents a commercial motor vehicle from a rent-a-car business operator shall use the motor vehicle for transport with compensation;
Nevertheless, from the end of October 2012 to March 14, 2013, the Defendants conspired to use the DNA passenger car, which is a commercial automobile leased by C, a car rental business entity, in the Gangnam-gu Seoul Metropolitan Government from the end of October 2012 to the end of March 14, 2013, for transportation by receiving 10,000 won for only one time for an unspecified number of employees of an entertainment business entity, who are passengers, and thereby, operated passenger transport business.
2. Defendant A
(a) Any person who intends to operate passenger transport business in violation of the Passenger Transport Service Act shall obtain a license or registration from the competent authority, and no person who rents a commercial motor vehicle from a rent-a-car business entity shall use such motor vehicle for transport with compensation
Nevertheless, the Defendant, from July 2012 to March 14, 2013, received a license or registration for passenger transport business and used the Franchising passenger car, which is a commercial automobile leased from E Co., Ltd., a car rental business entity in Gangnam-gu Seoul, Gangnam-gu, to an unspecified number of employees of an entertainment business entity, who is a passenger, for transportation by receiving KRW 10,000 per single fee, and thereby, operated passenger transport business.
B. Around 17:50 on March 14, 2013, the Defendant, without a vehicle driver’s license, driven a fluter vehicle in a section of about 500 meters from the roads 262-16, Gangnam-gu, Seoul, Gangnam-gu, Seoul to the roads 237-10, supra.
