Reasons

1. Basic facts

A. The Defendant is a federation established by the bus transport business association established under the Passenger Transport Service Act in order to achieve its common purpose under the same Act. The Plaintiff is a person who was employed by the Defendant on September 14, 1992 and was retired from office on July 31, 2019.

B. The Defendant’s employees of Grade 1 in Article 12 of the Wage Regulations shall apply the wage peak system only to the basic salary for two years (for a year, 90%, 2 year, 80%, and 70% payment) and for three years (for a year, 1 year, 90%, 2 year, 80%, and 3 year, 3 year, 70% payment). “The wage peak system (hereinafter “the instant wage peak system”) was implemented, but the said provision (hereinafter “instant provision”) was applied only to the ordinary wage for two years immediately preceding the retirement age (for a year, 1 year, 75%, 2 year, 70% payment).

C. 1) Pursuant to the instant provision, the Defendant paid the Plaintiff wages calculated by applying 75% of the wage peak system in the first year (one year period from the day immediately preceding the date of retirement to the date of retirement), and the second year (the period from the day immediately preceding the date of retirement to the date of retirement) in the second year (the period from the day immediately preceding the date of retirement to the date of retirement) with the payment rate of 70%.
