1. The defendant shall pay 26,283,000 won to the plaintiff and 20% per annum from April 7, 2015 to the day of complete payment.
Reasons
1. Indication of claim;
A. On February 17, 2013, the Plaintiff entered into a lease agreement with the Defendant and the original city, setting the lease deposit amount of KRW 40 million, and the lease period of KRW 2 years from March 2, 2013.
B. During the term of the above lease agreement, the auction procedure of the real estate was commenced as the original state branch D with the Chuncheon District Court. Since the Plaintiff received dividends of KRW 13,716,861 during the above auction procedure, the Plaintiff demanded the Defendant to return the remaining lease deposit amount of KRW 26,283,00,000 after deducting the said dividends.
2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
