A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. From May 7, 2015, the Defendant has been engaged in the duties of finance by managing the corporate account of the said company from Gangnam-gu Seoul and the victim D Co., Ltd. from around May 7, 2015.

As above, the Defendant, while taking charge of the financial affairs of the victim company, thought that the Defendant transferred the money owned by the victim company in the above account to the account in the name of the victim company to the account in the name of the defendant to use it for personal purposes.

On May 19, 2015, the Defendant transferred 4,200,000 won, which was recorded in the above account that was kept for the victim company at the office of the victim company, to the Suhyup account (Account Number:F) in the name of the Defendant, and consumed it for personal use, such as living expenses.

In addition, from around that time to August 21, 2015, the Defendant consumed a total of KRW 349,393,780 for personal purposes by means of the foregoing 39 times as indicated in attached Table 1.

Accordingly, the defendant embezzled the victim's property.

2. No person who violates the National Sports Promotion Act shall gambling using a prohibited act in which the person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, has issued sports betting tickets or similar things and used them to provide property or property benefits to those who win at the betting;

On May 7, 2015, the Defendant connected the Internet private sports soil site "G" by using a computer at the French site, and deposited KRW 100,000 to the national bank account in the name of the company that was designated by the above site operator as the gambling fund deposit account, and charged the corresponding game money, and predicted the result of the failure to work on board at the above site in the sports games, such as the livestock shed, camping district, etc. at home and abroad.
