Reasons
[criminal record] On July 28, 2011, the Defendant and the person requesting an attachment order (hereinafter “Defendant”) were sentenced to imprisonment with prison labor for murder, etc. at the Changwon District Court, and completed the execution of the sentence on March 1, 2016 at the Jinju Prison.
【2016 Gohap 224’s / [criminal facts] The Defendant had been aware of about 10 years prior to and around March 2016 of the Victim C (M, 27 years of age) and from around August 2016 of the Victim’s male relationship, causing conflicts, and thereafter, he/she has continued to contact the Victim and has demanded to contact the Victim even thereafter.
1. Around 00:10 on September 4, 2016, the Defendant: (a) sought a victim’s face “E” located in Kimhae-si, Kim Jong-si, where the victim was an employee; (b) took three times a part of the victim’s face on the ground that the victim refused it; and (c) assaulted the victim when the victim was able to take part in the victim’s back head and take part in the victim’s back head on six occasions on the ground that the victim refuses it.
2. As described in paragraph 1, the Defendant suffered special injury: (a) committed assaulting the victim; (b) forced the victim to leave the FF-learning passenger car parked in the vicinity of the singing room; and (c) parked the said passenger car at around 00:20 on the same day after driving the said car; (d) parked the victim’s mobile phone at around 00:20 on the same day; (b) on the ground that the victim confirmed the victim’s cell phone contents of H message, telephone call details, etc. and contacted another man, the victim was flicking his head and flicking the victim’s back on the ground that the victim confirmed the victim’s cell phone contents with the victim’s cell phone in contact with the other man; and (c) one set, which is a dangerous thing that the victim prepared in advance after taking the back part of the victim’s front window and hand at drinking, (e.g., 12., 5 cm in length on the blade and 22.5 cm in total).
