The punishment of the accused shall be determined by a year of imprisonment.
Provided, That the above punishment shall be imposed for two years after the judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, a victim, established for the purpose of the event B, worked as the secretary-general in C (hereinafter referred to as “C”), and performed the project under the delegation of the B event program from C, a subsidiary entity of the B event.
1. From January 22, 2016 to July 25, 2016, the Defendant received local subsidies of KRW 1,271,913,00,00 from a non-state bank account in the name of C (E).
On March 10, 2016, the Defendant used 2,250,000 won from among the subsidies received at the Filju-gun, North Korea, as above, as living costs, from that time to August 2, 2016, and used 44,050,000 won in total for five times, such as the list of crimes, in the list of crimes, and embezzled C’s funds for business purposes and uses subsidies for other purposes.
2. Occupational embezzlement;
A. On July 24, 2014, the Defendant embezzled KRW 23,527,510 of the earnings from paid events in the year 2014 to the CD Bank account (G) by remitting KRW 13,000,000 to the passbook in the name of H in order to repay personal debt.
B. Around May 19, 2015, the Defendant withdrawn KRW 13,000,000,042 from CD Bank Account (G) that was kept for the said C for business purposes, and embezzled by using KRW 13,000,000 for the daily cost of living in the former Non-Gun of North Korea.
