1. On June 15, 2015, the Defendant paid fuel subsidies to the Plaintiff for the truck A, KRW 57,965,401.

Reasons

1. Details of the disposition;

A. On July 22, 2010, the Plaintiff, a company running a general trucking transport business, such as the Plaintiff’s report on the scrapping of the company, reported the scrapping of the company to a general truck, the supply of which was permitted on July 22, 2010, and registered the scrapping of the company in accordance with the receipt of the report.

(hereinafter referred to as the “instant truck,” and the above registration of the scrapping of the instant truck was made. B.

On July 28, 2010, the Plaintiff transferred the instant truck to Seongbuk-gu Limited Liability Company (hereinafter referred to as “Songsung-gu”).

C. From August 2010 to June 2015, the GIC received the fuel subsidy of KRW 57,965,401 in total, from August 2010 to June 2015, the Plaintiff applied for the fuel subsidy for the instant truck after the said transfer.

On June 15, 2015, the Defendant issued a disposition to recover fuel subsidies to the Plaintiff on the following grounds, pursuant to Articles 43(2), 44(3) and (2) of the former Trucking Transport Business Act (amended by Act No. 13382, Jun. 22, 2015; hereinafter “former Trucking Transport Business Act”) and Articles 6 subparag. 1 and 26 of the Management Regulations for Trucking Fuel Subsidies (hereinafter “instant Management Regulations”), to recover KRW 57,965,401 (hereinafter “instant restitution disposition”).

Trucking Transport Business Act Article 3 (3) of the Trucking Transport Business Act (the investigation of the Gwangju Regional Police Agency and the investigation of the Gwangju Regional Police Agency-954, December 26, 13), which is permitted to be supplied, shall be registered as a general truck with supply-restricted general truck (the illegal registration number) on July 22, 2010 after entering the type of the report on scrapping for a special purpose-type vehicle in a business (general type) and issuing a notification for scrapping at the Gwangju Cargo Association in an unlawful manner after entering it in the business use.
