The defendant shall be punished by imprisonment with prison labor for 8 months and imprisonment with prison labor for 6 months.

Punishment of the crime

On April 28, 2011, the defendant was sentenced to 8 months of imprisonment and 2 years of suspended execution for the violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes in the Seoul Eastern District Court, and the above judgment was finalized on September 21, 201.

[2013 Highest 1002] No person shall receive, request, or promise money, valuables, or other benefits with respect to the arrangement of matters belonging to the duties of an executive or employee of a financial company, etc.

1.(a)

On October 21, 2009, the Defendant provided money and valuables to the J, “I” coffee store located in Songpa-gu Seoul, Songpa-gu, Seoul, stating that “I will have a branch of K branch of our bank, 2 billion won will be given a loan to a financial institution.” On November 17, 2009, the Defendant received KRW 15 million from the said J as a check, and received money and valuables as to the intermediation of loans, which are matters related to the duties of executive officers and employees of financial companies, etc.

B. On January 7, 2010, the Defendant, at a place where the place is unknown, provided that 2 billion won is to be loaned to J as stated in the foregoing paragraph (a), but at the K branch of Korea Bank, 1 billion won was loaned at the K branch of the Korea Bank, the Defendant provided the J with money and valuables to arrange a loan, which is a matter pertaining to the duties of officers and employees of financial companies, etc., by receiving KRW 10 million from the said J on February 10, 2010 and receiving KRW 10 million from the said J.

2. On May 6, 2010, the Defendant received money and valuables from the “M hotel” located in the Jung-gu Busan Metropolitan City L to the effect that “I will get loans from 1.8 billion to 2 billion won as security for M hotel. If there are many people who want to get a loan from a financial institution, I would be possible to talk with a large number of people who want to get a loan from a financial institution.” In other words, I would like to receive KRW 10 million from the above N to a new bank account (P) in the name of theO, and received money and valuables for arranging a loan, which belongs to the duties of an officer or employee of a financial institution.

3. On August 7, 2010, the Defendant may know the trade name in the Dong-dong Station of Gwangjin-gu Seoul Special Metropolitan City.
