Reasons
1. Basic facts
A. Defendant Korea Investment Trust Operation Co., Ltd. (hereinafter “Defendant Korea Investment Trust Operation”) is a collective investment entity under the Financial Investment Services and Capital Markets Act (hereinafter “Capital Markets Act”), and manages the Korea Investment Services and Capital Markets Act (hereinafter “Korea Investment Services and Capital Markets Act”) and the Korea Real Estate Investment Trust No. 11 (hereinafter “TA”) and the Korea Real Estate Investment Trust No. 11 (hereinafter “TA”). The Plaintiff is the sole investor and beneficiary of the TAD Fund, and the Defendant Korea Teachers’ Credit Union is the said 3rd Funds.
B. Around May 2013, each of the instant funds, the purport of which is to invest money in the loans to Korea Investment Trust Co., Ltd. (hereinafter “Korea Investment Trust Co., Ltd.”), which is promoting a golf course development project in Taean-gun, Taean-gun, Taean-gun (hereinafter “Korea Investment Trust”), and the management of Defendant Korea Investment Trust entrusted 3rd Funds to the Non-Party Korea Securities Bank Co., Ltd. (hereinafter “Korea Securities Bank”), and 3rd Funds to the Non-Party Korea Securities Bank (hereinafter “Korea Securities Bank”).
C. On May 29, 2013, the Korean Securities Finance and the Korean National Bank concluded the instant loan agreement with the Defendant Korea Securities Finance and the Korean National Bank to lend KRW 59 billion to Han InvestmentV as a lender (the actual loan of KRW 58.9 billion was made; hereinafter “instant loan agreement”); on December 30, 2016, to lend additional KRW 1 billion to Han InvestmentV, KRW 59.9 billion, in total, KRW 1.9 billion to the Korean Securities Finance Co., Ltd. KRW 29.9 billion, KRW 44.9 billion, KRW 5.9 billion, KRW 5.5 billion, KRW 59292, KRW 7129, KRW 4788, KRW 14888, KRW 599, KRW 5.9 billion, KRW 5.000,000, KRW 14.5 billion,000.
